Statement of work,
then the work,
then written acceptance.
The working process from the first message to a written acceptance: who the contracting party is, who runs the project, which documents you keep, how the estimate is worked out and how project data is protected.
Unlike on a marketplace, the contract is with VELKERN.
On a freelance marketplace the contract is with the contractor, so management and acceptance stay with you and documents come from each contractor separately. Here the contractors have contracts with VELKERN, not with you.
The statement of work is written before the work.
The result is later accepted against it, and without criteria on paper nothing settles an argument about whether the work is done. The manager reports where the project stands and is your single point of contact.
Every document comes from one counterparty.
The contract, a written acceptance for each stage and an invoice all come from VELKERN, and the rights to the work are set out in the contract with you. If something goes wrong, you take it up with that same counterparty.
You pay for scope, for hours or for an assigned team.
Fixed Price fixes the scope in the statement of work and the price in the contract. Time & Materials bills the hours worked, and the scope can change. A dedicated team is paid by period. Rates and an estimate follow a brief.
An NDA with contractors is signed before any material is handed over.
Access to the client's systems is given by role and for the term of the work, and credentials are passed and stored encrypted only. Working files stay in agreed systems. VELKERN reports an incident to the client and records what happened.
VELKERN is ready to sign a DPA under GDPR Art. 28.
Sub-processor terms and data transfers are agreed separately. Data protection contact: [email protected].
What an NDA covers
An NDA is a non-disclosure agreement. It sets out what the parties treat as confidential, who those details may be passed to, and what follows a breach. Technically it locks nothing: an NDA gives grounds for a claim if material goes where it should not.
What a DPA is
A DPA is a data processing agreement between a client and a supplier. Where GDPR Art. 28 applies, the supplier processes personal data on the client’s instructions under such an agreement, which must describe the subject and duration of the processing, the client’s instructions, and the use of sub-processors.
